Employee benefit plans can be categorized as large or small plans. Small plans generally do not require an audit. A large plan has more than 100 participants with balances as of the first day of the plan year. Generally, a large plan requires an audit, as mandated by the Employee Retirement Income Security Act (ERISA).
Defined contribution plans, defined benefit plans, and health plans are all subject to ERISA. The annual audit is attached to the Form 5500 (Annual Return/Report of Employee Benefit Plan) filing. The Form 5500 filing is due seven months after the plan year end. You can request a 2 ½ month extension.
